Please read these terms carefully before using GYMBIM. By accessing or using our platform, you agree to be bound by these terms.
1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and TECHIMPACE INNOVATIONS PRIVATE LIMITED (CIN: U62099WB2025PTC280498) governing your access to and use of GYMBIM, including the website, cloud platform, mobile applications, and related services.
By creating an account, subscribing to a plan, or using GYMBIM in any manner, you confirm that you are at least 18 years old and have authority to bind your organization to these Terms.
2. Description of Service
GYMBIM is proprietary cloud-based gym management software providing member management, biometric access control, payment processing, attendance tracking, reporting, and related features as described on our website and in your subscription plan.
We reserve the right to modify, suspend, or discontinue any feature with reasonable notice. Critical changes affecting core functionality will be communicated at least 30 days in advance.
3. Account Registration & Security
You must provide accurate, complete registration information and keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
Notify us immediately at office@techimpace.com of any unauthorized access. We are not liable for losses arising from your failure to safeguard credentials.
4. Subscription & Payment
GYMBIM is offered on subscription plans as published on our pricing page. Fees are billed in advance on a monthly or annual basis unless otherwise agreed.
All fees are exclusive of applicable taxes (including GST). You are responsible for all taxes associated with your subscription.
Failure to pay may result in suspension of access after a 7-day grace period. See our Refund Policy for cancellation terms.
5. Acceptable Use
You agree not to: use GYMBIM for unlawful purposes; upload malicious code; attempt unauthorized access to our systems or other accounts; reverse engineer, decompile, or copy the software; resell or sublicense without written consent; or use the platform to harass, defame, or harm others.
You are solely responsible for member data you upload and must have lawful basis and consent to process such data, including biometric information.
Violation of acceptable use may result in immediate account suspension or termination without refund.
6. Intellectual Property
GYMBIM, including all software, designs, logos, documentation, and content, is the exclusive property of TECHIMPACE INNOVATIONS PRIVATE LIMITED. No rights are granted except the limited license to use the service per your subscription.
You retain ownership of your data. You grant us a license to process your data solely to provide and improve the service.
7. Data Protection
Our collection and use of personal data is governed by our Privacy Policy and applicable compliance frameworks (DPDPA, GDPR, CPCPA). Gym operators are responsible for providing privacy notices to their members.
8. Service Availability & Support
We target 99.9% platform uptime excluding scheduled maintenance (communicated in advance). Support levels vary by plan as described on our pricing page.
GYMBIM is provided on an "as is" basis. See our Disclaimer for limitations of liability.
9. Termination
Either party may terminate with 30 days written notice. We may terminate immediately for material breach, non-payment, or violation of these Terms.
Upon termination, your access ceases and data export is available for 30 days. After that, data is deleted per our Privacy Policy.
10. Governing Law & Disputes
These Terms are governed by the laws of India. Courts in Bardhaman, West Bengal shall have exclusive jurisdiction, subject to mandatory consumer protection laws in your jurisdiction.

11. Changes to Terms
We may update these Terms periodically. Material changes will be notified 30 days before taking effect. Continued use after the effective date constitutes acceptance.
